1. Introduction
Welcome to Luxe Live ("Company," "we," "our," or "us"). We are committed to protecting your personal information and your right to privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform — including the Luxe Live website at luxe-live.com, our mobile applications, and all associated services (collectively, the "Platform").
By using our Platform, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the Platform.
This policy should be read alongside our Terms of Service, which governs your use of the Platform.
2. Information We Collect
2.1 Information You Provide Directly
- Account Registration: When you create an account, we collect your username, email address, password (stored as a secure hash), display name, and optional profile photo.
- Profile Information: Bio, location, website links, and any other details you add to your public profile.
- Payment Information: When you purchase Luxe Gold or initiate payouts, we collect billing details. Full payment card numbers are processed and stored by our payment processor (Stripe) — we never store raw card data on our servers.
- Messages & Communications: Content of direct messages, message requests, and any reports you submit. Live stream chat messages are also stored.
- Support Requests: Information you provide when contacting our support team, including your name, email, and the content of your inquiry.
- Identity Verification: If you request a payout, we may collect government-issued ID information as required by applicable law and Stripe's Know Your Customer (KYC) requirements.
2.2 Information Collected Automatically
- Usage Data: Pages visited, features used, time spent on the Platform, search queries, and actions taken (e.g., gifts sent, lives joined).
- Device & Technical Data: IP address, browser type and version, operating system, device identifiers, screen resolution, and language settings.
- Log Data: Server logs that record requests, timestamps, error codes, and referring URLs.
- Live Stream Data: Start/end times, viewer counts, gifts exchanged, and Emerald conversions associated with your streams.
- Cookies & Similar Technologies: See Section 5 below.
2.3 Information from Third Parties
- Social Sign-In: If you register or sign in using Apple or Google, we receive your name, email address, and unique identifier from those providers. We do not receive your password for those services.
- Payment Processors: Stripe provides us with transaction confirmations, payment status, and fraud signals.
- Analytics Providers: Aggregated and anonymized data from analytics services we use to improve the Platform.
3. How We Use Your Information
We use the information we collect for the following purposes:
- Account Management: Creating, maintaining, and securing your account; verifying your identity; processing authentication.
- Platform Operation: Delivering live streams, enabling social interactions (follows, gifts, messages), managing virtual currency (Luxe Gold & Emeralds), and facilitating creator payouts.
- Communications: Sending service-related notifications (live alerts, gift receipts, message requests, payout confirmations), transactional emails, and responding to support requests.
- Safety & Moderation: Detecting and preventing fraud, abuse, spam, and violations of our Terms of Service; enforcing bans, ghost statuses, and moderator actions.
- Improvement: Analyzing usage patterns to improve features, fix bugs, and develop new services.
- Legal Compliance: Meeting our obligations under applicable law, including financial regulations related to payouts and tax reporting.
- Marketing: With your consent, sending promotional content about new features or offers. You may opt out at any time.
We do not sell your personal information to third parties for their marketing purposes.
6. Live Streaming & Real-Time Data
When you broadcast a live stream:
- Your video and audio are transmitted in real time to viewers via WebRTC. We do not permanently store the raw video/audio of live streams unless we explicitly inform you otherwise.
- Chat messages sent during a live stream are stored in our database and associated with your account.
- Gift transactions (Luxe Gold spent / Emeralds earned) are permanently recorded for accounting and payout purposes.
- Viewer counts and top-gifter leaderboards are maintained and displayed publicly on your profile.
- Stream start/end times and duration are logged for moderation and analytics purposes.
When you watch a live stream, your presence as a viewer is counted. Your gifts and chat messages are visible to the broadcaster and all other viewers in real time.
7. Payments & Financial Data
All payment processing is handled by Stripe, Inc. We use Stripe's Checkout Session API (embedded payment element) to securely collect payment information. Stripe's privacy policy is available at stripe.com/privacy.
- We store records of Luxe Gold purchases (amount, timestamp, transaction ID) for accounting and dispute resolution.
- We store Emerald balances and gift histories for payout calculation and leaderboard display.
- For creator payouts, we are required to collect and transmit certain financial information (e.g., bank account details, tax identification numbers) to Stripe as part of their KYC process. This information is transmitted directly to Stripe and is subject to their privacy policy.
- We may retain financial transaction records as required by applicable tax and financial regulations (typically 7 years).
8. User-Generated Content
Content you post on the Platform — including profile photos, bios, live stream chat, and any media — may be visible to other users and is subject to our content moderation practices.
- Content reported by users is reviewed by our moderation team and may be retained for review purposes even after deletion from public view.
- We reserve the right to remove content that violates our Terms of Service.
- Direct messages and message requests are private between the involved parties and are not displayed publicly. However, they may be reviewed by our trust and safety team in response to reports.
9. Data Retention
We retain your information for as long as your account is active or as needed to provide you with services. Specifically:
- Account Data: Retained for the life of your account. If you delete your account, we remove it from public visibility but may retain certain data for up to 90 days for fraud prevention and legal compliance.
- Ghost-Status Accounts: Accounts placed in ghost status are removed from public view but not deleted from our database; associated data is retained for moderation and audit purposes.
- Financial Records: Transaction records are retained for a minimum of 7 years as required by financial regulations.
- Chat & Messages: Retained for 2 years from the date of the message, after which they may be purged.
- Log Data: Server logs are retained for up to 90 days.
10. Security
We implement industry-standard security measures to protect your information:
- All data in transit is encrypted using TLS/SSL (HTTPS).
- Passwords are stored using bcrypt hashing — we never store plaintext passwords.
- Our servers are hosted on Amazon Web Services with restricted access controls.
- Payment data is handled exclusively by Stripe, which is PCI DSS compliant.
- We conduct periodic security reviews and promptly address identified vulnerabilities.
Despite these measures, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security, and you use the Platform at your own risk. If you believe your account has been compromised, contact us immediately at security@luxe-live.com.
11. Children's Privacy
The Platform is intended for users who are at least 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child under 13 has created an account or provided us with personal information, please contact us at privacy@luxe-live.com. We will take steps to delete the information and terminate the account.
Users between the ages of 13 and 18 should review this policy with a parent or guardian. Certain features — including purchasing Luxe Gold and requesting payouts — are only available to users who are 18 years of age or older.
12. Your Rights & Choices
You have the following rights with respect to your personal information:
- Access: You may request a copy of the personal data we hold about you.
- Correction: You may update inaccurate or incomplete information through your account settings or by contacting us.
- Deletion: You may request deletion of your account and associated data (subject to our retention obligations described in Section 9).
- Data Portability: You may request an export of your data in a machine-readable format.
- Opt-Out of Marketing: You may opt out of promotional emails by clicking the "unsubscribe" link in any marketing email or by contacting us.
- Push Notifications: You may disable push notifications through your device settings.

13. California Privacy Rights (CCPA)
If you are a California resident, the California Consumer Privacy Act (CCPA) grants you additional rights:
- Right to Know: You have the right to know what personal information we collect, use, disclose, and sell about you.
- Right to Delete: You have the right to request deletion of your personal information.
- Right to Opt-Out: We do not sell your personal information. You therefore do not need to opt out of any sale.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.

14. European Users (GDPR)
If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have rights under the General Data Protection Regulation (GDPR) and applicable national laws.
Legal Basis for Processing
- Contract Performance: Processing necessary to provide the Platform services you've requested (account creation, live streaming, payments).
- Legitimate Interests: Platform security, fraud prevention, analytics, and service improvement.
- Legal Obligation: Compliance with applicable laws and regulations.
- Consent: Marketing communications and certain optional features (you may withdraw consent at any time).
International Transfers
Your data may be transferred to and processed in the United States, where our servers are located. The U.S. may not have the same data protection laws as your country. We rely on Standard Contractual Clauses and other appropriate safeguards for international transfers.
GDPR Rights
In addition to the rights listed in Section 12, you have the right to lodge a complaint with your local data protection authority (DPA). To find your DPA, visit the European Data Protection Board website at edpb.europa.eu.

15. Third-Party Links & Services
The Platform may contain links to third-party websites, applications, or services that are not owned or controlled by Luxe Live. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you visit. We are not responsible for the privacy practices of any third parties.

16. Changes to This Policy

- Display a prominent notice on the Platform for at least 30 days.
Your continued use of the Platform after any changes take effect constitutes your acceptance of the revised Privacy Policy. If you do not agree to the changes, you must discontinue using the Platform.
