Terms of Service

Please read these terms carefully before using Luxe Live.

Welcome to Luxe Live ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website located at luxe-live.com, our mobile applications, and all related services (collectively, the "Platform"). By accessing or using the Platform you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and Luxe Live. Your continued use of the Platform after any modification to these Terms constitutes acceptance of those modifications.

2. Eligibility

The Platform is intended for users who are at least 13 years of age. By using the Platform, you represent and warrant that:

  • You are at least 13 years old (or the applicable age of digital consent in your jurisdiction);
  • If you are between 13 and 18 years old, you have obtained parental or guardian consent;
  • You have the legal capacity to enter into a binding contract;
  • Your use of the Platform does not violate any applicable law or regulation.

Certain features — including purchasing Luxe Gold, receiving payouts, and accessing adult-content sections (if applicable) — require users to be at least 18 years of age.

3. Account Registration

To access most features of the Platform you must create an account. When registering you agree to:

  • Provide accurate, current, and complete information;
  • Maintain and promptly update your account information;
  • Keep your password secure and confidential;
  • Notify us immediately of any unauthorized use of your account;
  • Accept responsibility for all activities that occur under your account.

We reserve the right to refuse registration, suspend, or terminate any account at our sole discretion, including if we determine that you have violated these Terms.

You may register using email/password, Apple Sign In, or Google Sign In. Third-party sign-in methods are governed by the terms of those providers in addition to these Terms.

4. User Content

4.1 Your Content

"User Content" means any text, photos, videos, audio, live streams, comments, messages, profile information, or other material you submit to the Platform. You retain ownership of your User Content, but by posting it you grant Luxe Live a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, display, reproduce, modify, adapt, publish, and distribute your User Content in connection with operating and improving the Platform.

4.2 Content Standards

All User Content must comply with the following standards. Content must not:

  • Be defamatory, obscene, offensive, hateful, or inflammatory;
  • Contain sexually explicit material involving minors under any circumstances;
  • Infringe any intellectual property rights of any third party;
  • Contain nudity or sexually explicit material unless permitted in designated age-gated sections;
  • Promote or facilitate illegal activities, violence, or self-harm;
  • Harass, bully, intimidate, or discriminate against individuals;
  • Contain malware, viruses, or any harmful code;
  • Impersonate any person or entity or misrepresent your affiliation.

4.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, at any time and without notice. Users may report content using the in-app reporting feature, and moderators will review flagged content.

5. Live Streaming

Luxe Live allows users to broadcast live video streams to other users ("Live Streams"). By going live you agree to:

  • Comply with all applicable laws regarding broadcasting and content;
  • Not stream any prohibited content as defined in Section 4.2;
  • Accept that moderators and platform administrators may end your stream at any time;
  • Accept that viewers may be removed from your stream by you, designated moderators, or platform staff;
  • Understand that battles — competitive engagements scored by viewer gifts — may only occur during an active live stream;
  • Ensure you have all necessary rights and permissions for any content appearing in your stream, including music, video clips, and appearances by third parties.

We do not guarantee continuous availability of live streaming features. We may impose limits on stream duration, viewer counts, or geographic availability.

6. Luxe Gold & Emeralds

6.1 Luxe Gold (Virtual Currency)

"Luxe Gold" is the Platform's virtual currency, purchased with real money through the in-app store. Luxe Gold has no cash value and may not be redeemed for real money by purchasers. Luxe Gold may only be used to purchase virtual gifts on the Platform.

  • Luxe Gold purchases are final and non-refundable except as required by applicable law;
  • Luxe Gold has no expiry date while your account remains active in good standing;
  • Luxe Gold is non-transferable between accounts;
  • The Company reserves the right to modify Luxe Gold pricing and exchange rates at any time.

6.2 Emeralds (Creator Earnings)

"Emeralds" are a creator-specific unit earned when you receive virtual gifts from other users. Emeralds represent potential earnings and are subject to the following:

  • The Luxe Gold-to-Emerald conversion rate is set by the Company and may change with notice;
  • Emeralds may be exchanged for real-money payouts subject to the Payout Policy in Section 7;
  • Emeralds earned through fraudulent activity may be forfeited without compensation;
  • Emerald balances will be displayed on creator profiles and platform leaderboards.

6.3 Gift Packages

Virtual gifts are in-app items purchased with Luxe Gold and sent to creators during live streams or on posts. Gift packages, their Luxe Gold cost, and their Emerald conversion value are set by the Company and may be updated at any time. Gifts are non-refundable once sent.

7. Payments & Billing

All purchases on the Platform are processed through our payment provider, Stripe. By making a purchase you agree to Stripe's Terms of Service. You authorize us to charge your chosen payment method for all fees incurred.

  • Prices are displayed in United States Dollars (USD) unless otherwise indicated;
  • All prices include applicable taxes unless stated otherwise;
  • Subscription plans (if applicable) auto-renew until cancelled;
  • You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period;
  • Refunds are issued only where required by applicable law or at our sole discretion.

8. Creator Payouts

Creators who have accumulated Emeralds may request a payout subject to the following conditions:

  • A minimum payout threshold applies (displayed in the creator dashboard);
  • You must complete identity verification (KYC) before your first payout;
  • Payouts are processed within 7–10 business days of approval;
  • The Company retains a platform fee on all payouts (percentage disclosed in the creator dashboard);
  • Payouts may be withheld if we suspect fraudulent activity, Terms violations, or pending investigations;
  • You are solely responsible for any applicable taxes on payout income.

9. Prohibited Conduct

You agree not to engage in any of the following while using the Platform:

  • Violating any applicable local, state, national, or international law;
  • Using automated tools (bots, scripts, scrapers) to access or interact with the Platform;
  • Attempting to gain unauthorized access to any part of the Platform or its infrastructure;
  • Artificially inflating engagement metrics, gift counts, or Emerald balances;
  • Buying, selling, or transferring accounts;
  • Spamming, phishing, or distributing unsolicited commercial communications;
  • Circumventing or disabling any security or access-control features;
  • Reverse-engineering any part of the Platform;
  • Using the Platform to facilitate pyramid schemes, multi-level marketing, or fraudulent schemes.

10. Moderation

The Platform employs a tiered moderation system:

  • Moderators may review reported content, remove users from live streams, and end live streams that violate these Terms;
  • Creators may appoint moderators for their own live streams and may remove viewers from their streams;
  • Administrators have full authority to take any action necessary to enforce these Terms, including account suspension or termination;
  • Moderation decisions are final, though you may appeal by contacting support.

Users found to have abused the reporting system may have their reporting privileges restricted.

11. Intellectual Property

The Platform and its original content (excluding User Content), features, functionality, design, logos, and trademarks are the exclusive property of Luxe Live and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Platform without our express written permission.

The "Luxe Live" name, logo, and all related marks are trademarks of the Company. You are granted no license or right to use any Company trademark.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • The Platform will be uninterrupted, error-free, or secure;
  • Any defects or errors will be corrected;
  • The Platform or servers are free of viruses or other harmful components;
  • The results obtained from using the Platform will be accurate or reliable.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LUXE LIVE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Platform;
  • Any conduct or content of any third party on the Platform;
  • Any content obtained from the Platform;
  • Unauthorized access, use, or alteration of your transmissions or content.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

15. Indemnification

You agree to defend, indemnify, and hold harmless Luxe Live and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform, including but not limited to your User Content, any use of the Platform's content or services other than as expressly authorized, or your use of any information obtained from the Platform.

16. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Platform immediately ceases;
  • Any outstanding Luxe Gold balance is forfeited and non-refundable (except where required by law);
  • Any pending Emerald payout may be processed at our discretion, subject to our fraud review;
  • Provisions of these Terms that by their nature should survive termination shall survive.

You may deactivate your account at any time by contacting support. We may retain your data as described in our Privacy Policy.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Suffolk County, Massachusetts for the resolution of any disputes.

If you are located outside the United States, additional or different local laws may apply to you. Nothing in these Terms limits your rights under applicable mandatory consumer protection laws in your country of residence.

18. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide at least 14 days' notice of any material changes by:

  • Posting a notice on the Platform;
  • Sending an in-app notification; and/or
  • Sending an email to the address associated with your account.

Your continued use of the Platform after any changes take effect constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Platform.
